The Company, offers a suite of messaging software-as-a-service solutions through a single platform to enable its customer to manage communications with their users under the name of “What A Six”.
The Company may, at its sole discretion, authorize such persons from time to time, who shall carry out all or any of its rights, duties and obligations under these Terms of Use and under these Terms of Use shall be construed to mean and include any such persons duly authorised and acting on behalf of the Company.
These Terms of Use are an electronic record in terms of the Information Technology Act, 2000, the applicable rules thereunder and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. These Terms of Use are generated by a computer system and does not require any physical or digital signatures.
These Terms of Use are published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing of the rules and regulations, privacy policy and terms of use for access to or usage of any electronic devices and services.
Definitions
- Client/User/You: Any individual or business using our WhatsApp messaging or payment services.
- Services: WhatsApp API messaging service, automation tools, chatbot services, dashboards, and payment gateway solutions.
- WhatsApp Business API Provider: The official Meta-authorized provider through which we offer WhatsApp services.
By signing up, accessing, or using our services, you:
- Agree to these Terms
- Accept our Privacy Policy
- Confirm you are at least 18 years old
- Agree to WhatsApp Business & Commerce Policies
a) Compliance with WhatsApp Policies
You must follow:
- WhatsApp Business Policy
- WhatsApp Commerce Policy
- WhatsApp Messaging Guidelines
We reserve the right to suspend your account if you violate any policy.
b) Message Sending Rules
You agree that:
- You will send messages only to customers who have opted-in.
- You will use only approved templates for promotional messages.
- You will not send spam, abusive, illegal, or misleading messages.
Violation may result in account blocking or termination.
You agree to:
- Provide accurate business and payment information
- Maintain account security
- Use services only for lawful purposes
- Not attempt to bypass or abuse the system
- Not share login access with unauthorized persons
You are responsible for all activity conducted under your account.
a) Subscription & Usage Fees
You must follow:
- Fees may include subscription charges, message charges, API charges, chatbot fees, and setup costs.
- GST and applicable taxes may apply.
- Charges may vary based on WhatsApp pricing set by Meta.
b) Payment Gateway
Payments are processed securely through [Payment Gateway Name, e.g., Razorpay/PayU/Stripe].
c) Billing
- All payments are due immediately unless specified otherwise.
- Unpaid invoices may result in service suspension.
- Recurring payments will be auto-debited if enabled.
d) No Refund Policy
Unless explicitly stated, all payments made are non-refundable due to API usage and prepaid credits.
We may suspend or terminate your account if:
- You send spam or policy-violating content
- You use WhatsApp service for illegal purposes
- You fail to pay outstanding dues
- You misuse the system or threaten platform security
We may also terminate service due to updates in WhatsApp or Meta policies.
Your data is handled according to our Privacy Policy
We follow industry-standard security practices but cannot guarantee 100% security of data transmission.
We strive to provide uninterrupted service but:
- WhatsApp API is dependent on Meta
- Downtime may occur from technical issues, maintenance, or provider outages
We are not liable for any losses caused by service interruptions.
Our services rely on:
- WhatsApp Business API
- Hosting providers
- Payment gateways
- SMS or email providers (if integrated)
We are not responsible for failures or actions of third-party vendors.
To the maximum extent permitted by law, we are not liable for:
- Loss of profits, business, revenue, or data
- Delays or failures caused by technical or API issues
- Unauthorized access to your account
- Penalties imposed by WhatsApp due to user misuse
Our total liability is limited to the amount paid by you in the last 30 days.
You agree to indemnify and hold [Your Company Name] harmless from any claims arising due to:
- Misuse of WhatsApp services
- Violation of policies or laws
- Customer disputes
- Payment disputes
- Illegal or unauthorized messaging activities
All content, software, designs, logos, brand elements, and documentation provided by us remain the property of “Softbranch” (What A Six).
You may not copy, distribute, or modify them without written permission.
We may update pricing or these Terms anytime.
We will notify users through email, WhatsApp, or website updates.
Continued use of the service after updates means you accept the changes.
These Terms are governed by the laws of India, and disputes shall be resolved in the courts of Delhi.
